The fallout from the 'Yellow Envelope Law' (Amendments to Articles 2 and 3 of the Trade Union and Labor Relations Adjustment Act) has spread to Samsung Electronics.
On the 6th, the Samsung Biologics Coexistence Labor Union sent a letter demanding collective bargaining with its second-largest shareholder, Samsung Electronics. Citing Article 2, Item 2, among others, of the 'Trade Union and Labor Relations Adjustment Act' (hereinafter referred to as the Trade Union Act), commonly known as the Yellow Envelope Law, the union stated its position that it would engage in collective bargaining with Samsung Electronics regarding personnel matters and wage systems.
The Samsung Biologics union claimed, “We have confirmed circumstances indicating that Samsung Electronics has been involved in working conditions, including common standards for personnel systems, evaluation and rank requirements, and the selection, development, and compensation levels of key personnel, as well as operational and modification procedures,” adding, “Samsung Electronics qualifies as an employer under the Trade Union Act to the extent that it can substantively and specifically dominate or determine (the working conditions of) Samsung Biologics.”
The Samsung Biologics union specified its negotiation demands with Samsung Electronics, including: △ common standards and operational procedures for job and rank systems, as well as evaluation, promotion, development, and selection systems; △ matters concerning the application to workers’ status and treatment; △ wage systems and pay bands by job and rank; △ compensation criteria based on evaluation and promotion; △ payment criteria and levels for wages, allowances, and incentives; and △ the design and operation of personnel and compensation systems for key personnel, among others.
The Samsung Biologics union proposed holding the first negotiation session at the Samsung Biologics facility in Songdo, Incheon, on the 14th.
Park Jae-sung, Noh Jo-wi (Director) of the Samsung Biologics union, stated, “Looking at the relationship between Samsung Biologics and Samsung Electronics, we determined that Samsung Electronics is in a position to exercise substantive control,” adding, “We plan to prove Samsung Electronics’ substantive control based on various materials.”
